Terms of service

These terms are the agreement between you and Kernel6 when you use kernel6.com. They are written to be read, not skimmed past.

1. The agreement

By creating an account or using Kernel6 (“we”, “us”), you agree to these terms, our privacy policy and our refund policy. If you are signing up for a business, you confirm that you are allowed to accept these terms on its behalf, and “you” means that business. You must be at least 18 years old.

2. The service

Kernel6 is managed website hosting. You point us at a Git repository. We build your app, run it on a server, serve it over HTTPS on an address we provide and on domains you add, and email you if it stops running.

  • Dedicated plan. Your own server, not shared with other customers, with 1 CPU and 4 GB of memory included. It runs as many of your websites as it can hold. The price starts at ₹2,000 a month, as shown on our pricing section when you subscribe.
  • Plans or features marked “coming soon” or “not available yet” are not part of what you are buying until they launch.

We may improve or change the service over time. If we remove something you are paying for, we will tell you in advance and you may cancel.

3. Your account

  • Give us accurate details and keep your email address up to date. It is where alerts and invoices go.
  • Keep your password and any API keys secret. You are responsible for what happens under your account, including through a key you created.
  • Tell us through the contact form as soon as you suspect someone else has access.

4. Your code and content

You own your code, your websites and everything on them. You give us permission to copy, build, store and run them only as needed to provide the service to you. We do not claim any other rights over them.

You are responsible for your websites: for having the right to use what is on them, for complying with the law (including data-protection law towards your own visitors), and for keeping your own copy of your code. Your source code stays in your Git repository. We run a copy of it, not the only copy.

5. Acceptable use

You may not use Kernel6 to host, send or run:

  • malware, phishing pages, or anything designed to deceive people into giving up credentials or money;
  • spam or bulk unsolicited email;
  • content that is illegal in India, or that infringes someone else’s copyright, trademark or privacy;
  • cryptocurrency mining, or workloads designed to consume resources rather than serve a website;
  • attacks on other systems, including scanning, denial-of-service, or attempts to access other customers’ apps or our infrastructure.

If you find a security problem in Kernel6, report it to us. See our security page. Do not exploit it.

6. Payment and renewal

  • Plans are billed in advance and renew automatically each period until you cancel.
  • Payments are taken by Razorpay, Stripe or Dodo Payments. Where Dodo Payments is used, it is the merchant of record for that transaction, and its terms apply to the payment.
  • Prices are shown before you pay, including any taxes the payment provider adds.
  • If we change a price, we will tell you before it applies to your next renewal, and you can cancel before then.
  • You can cancel any time from your billing page. Refunds are covered by our refund policy, which includes a 7-day money-back guarantee on your first payment.

7. Suspension and termination

We may suspend your websites, or close your account, if:

  • a payment is overdue and remains unpaid after we have told you;
  • you break the acceptable use rules above;
  • your account is putting other customers, our infrastructure or the public at risk; or
  • we are required to by law.

Where we can, we will warn you first and give you a chance to fix the problem. For serious abuse or legal orders we may act immediately. Suspending a site stops it being served. It does not delete your projects, settings or environment variables, and sites come back once the issue is resolved.

You can close your account at any time from Settings, once any active subscription is cancelled. Closing it stops and removes everything you run on Kernel6.

8. Availability

We work to keep your websites running, and we check every few minutes whether each one is up so we can tell you when it is not. We do not guarantee that the service will be uninterrupted or error-free. Servers need maintenance, providers have outages, and code can fail in ways nobody intended. We do not offer a service-level agreement or service credits unless we have agreed one with you in writing.

9. No warranty

The service is provided “as is” and “as available”. To the extent the law allows, we make no promises beyond those in these terms, including that the service will suit a particular purpose.

10. Limitation of liability

To the extent the law allows, Kernel6 is not liable for indirect or consequential losses, such as lost profits, lost revenue, lost data or lost business opportunities. Our total liability for any claim arising from the service is limited to the fees you paid us in the three months before the event that caused the claim.

Nothing in these terms limits liability that cannot be limited by law.

11. Your responsibility to us

If someone makes a claim against Kernel6 because of content you hosted or your breach of these terms, you agree to cover our reasonable costs of dealing with it.

12. Changes to these terms

We may update these terms. We will change the date at the top. If a change materially affects you, we will email you at least 15 days before it takes effect. Continuing to use Kernel6 after that means you accept the new terms. If you do not, you can cancel.

13. Governing law and disputes

These terms are governed by the laws of India. Any dispute that we cannot settle by talking to each other will be decided by the courts of competent jurisdiction in India.

14. Grievances and contact

Questions, complaints and grievances go through our contact form. Start the message with “Grievance” for complaints about content or data. We acknowledge grievances within 24 hours and aim to resolve them within 15 days.
